The Basics of Personal Injury Law

There are three different types of personal injury claims you can file.
Negligence
If your injury was a direct result of someone else’s negligent behavior, then you can file a claim based on pure negligence. Negligence is defined as the failure to take proper care when completing certain actions– medical malpractice, distracted drivers, and/or asbestos exposure through work are all examples.

Intentional Torts
An intentional tort is when someone purposefully sets out to injure you. A tort is an act of infringing on someone’s rights, and when it comes to personal injury law, a tort is considered a crime. This means that you as the injured person will still be able to file a civil suit against the defendant even if they are acquitted of all their criminal charges.

Strict Liability
A person is able to claim a personal injury due to strict liability if they are a victim of a product with a defect that results in your injury.

Personal Injury Settlements

There are two outcomes of any personal injury case, an informal settlement, or utilizing the court system for a formal lawsuit.

Informal Settlement: as the most common option, this is when all parties including the defendant and the victim, their insurance companies, and lawyers representing each side.

Formal lawsuits: this happens when the individual files a civil complaint against another business, corporation, or person.

No matter what path you choose, you will want an experienced personal injury attorney at your side to navigate you through the process. Hamilton Legal Services is here to help, so give us a call today.
